I just spoke with Dylan Schiemann (@dylans) and he gave me a list of items that will need to be addressed to become a foundation project:
- All of the code must be IP clean and be able to be contributed under the Dojo CLA (http://dojofoundation.org/about/cla).
- Someone must be the project lead (probably @kriskowal); this person must be committed to seeing the project through to become a success.
- Normally, someone must handle basic server operations. Since es5-shim is hosted on Github, this won't be a problem.
- A proposal must be written that will be voted on and approved by the foundation mailing list. Dylan is willing to provide feedback on the proposal before he or Alex Russell send it out to the foundation list for a vote.
If you guys would still like to proceed to send it to the foundation, I can provide you with a template proposal. Let me know if you have any other questions.

I think this project being outside any other project is good for this project. The es5-shim.js file has no dependencies and that will be less obvious if it is part of the dojo project because people will think they have to adopt all of dojo to get at the es5-shim.js functionality.

Being a part of the Dojo Foundation does not mean being a part of the Dojo Toolkit (much like being a part of the Apache Software Foundation doesn't mean being a part of [or needing to use] the Apache server). There are a few projects that are built on the Dojo Toolkit (Lucid Desktop, Maquetta), but the majority don't (TIBCO General Interface, CometD, Persevere, RequireJS, Sizzle, etc.).
One of the things that we'll have to do before becoming part of the Dojo Foundation is to contact all contributors and make sure their contributions are IP clean and have them sign a Dojo Foundation Contributor License Agreement (if they haven't done that already). I plan to do that in the coming weeks.
