To summarize, I'm sorry to say the extension is working as intended.
Here the background information if you are interested:
Products are independent of categories. The following scenario might clarify:

• Product A is associated to category CatA and also to category CatB
• Product A is visible to the current customer
• CatB is hidden to the current customer
• CatA is visible to the current customer

Now, if category visibility would be applied to associated products, would ProductA be visible to the current customer or hidden? There is no right answer.
Even if a product is associated with only a single hidden category, should that product then be visible when viewed as a simple product in a grouped or configurable product, or through the search?

The only real solution is to re-think the catalog structure to not use category visibility do define product visibility.

You are right, should be done more properly but I can't see a feasible solution without duplicating products. Problem was
Mage::getSingleton('catalog/product_visibility')->addVisibleInCatalogFilterToCollection($linkCollection);
in Enterprise_TargetRule_Block_Catalog_Product_List_Abstract::_getPreparedTargetLinkCollection which joins default category of the store view besides applying visibility. I've hacked it a bit by adding second level categories from Group Catalog index, seems to work, but not ideal solution

I can't think of a way without duplicating the products, either. Except for a "apply-to-products" flag on the category settings or something like that.
But that would make some things a lot more complex, so I'd rather not implement that, unless it's needed by many users.
