Test fail can leave kitchen in bad state, requiring .kitchen to be hand-deleted.

This was observed following the observation of the condition reported in #4.

Docker container destroy false fails, leading to kitchen reporting failure when tests pass

sshd restart problem with ubuntu-14.04 

platforms:
  - name: ubuntu-14.04

when you restart sshd in the container the entire container will stop and test-kitchen is unable to use it anymore. Even starting the container again wont bring back sshd
This does NOT happen with https://github.com/portertech/kitchen-docker however I do not know why.
It also does NOT happen with ubuntu-12.04

I've tested it with docker v1.0.1 with boot2docker as host, 1.2.0 with Ubuntu14 as host and 1.3.0 with Ubuntu12 as host.

Getting 400 Bad Request

Recently when running kitchen-docker-api in travis, I have been receiving the following error messages and did not know if others were getting the same thing:
